Barnabe Lucas was a 9 year old special needs child who was enrolled in a summer day camp operated by Christian Youth Center Ministries. On Wednesdays the camp took its campers to Leisure Lake Membership Resort to swim. The resort had a wading pond going from zero depth to 5 feet. 20 to 30 minutes after the campers arrived, another camper discovered Barnabe unconscious. He was pulled out and given CPR. He died 6 days later. Barnabe was mentally challenged with an IQ of 40 to 50 and functioned at the level of a 4 year old. He also had ADHD, impulsivity issues and a speech impediment. The estate contended that the defendants were negligent in failing to properly supervise the pond, failing to provide lifeguards, and failing to test the campers for swimming ability. Defendant Christian Youth Center Ministries claimed they were not aware of Barnabe’s disabilities at the time of his enrollment and that they would not have accepted him if they knew because they did not run a special needs camp.
Verdict:$1,986,654 against both defendants ($1,400,000 loss of society; $500,000 conscious pain and suffering; $76,686 medical expenses; $9,968 funeral expenses)
