Summary: Plaintiff was stopped and searched after he was observed engaging in a hand to hand transaction with a suspected narcotics dealer in an area known for narcotic sales. The police recovered 1.1 grams of cocaine from the Plaintiff’s pants pocket and Plaintiff was arrested. At a preliminary hearing, the Court found that there was no probable cause to believe Plaintiff was guilty of any offense. Plaintiff sued for false arrest and malicious prosecution and sought compensatory damages for aggravation of a pre-existing rotator cuff condition, humiliation, and emotional distress. The defense denied the allegations.
