Summary: Plaintiff was driving his car when he claimed he was cut off by Defendant’s delivery truck as it made a left turn causing Plaintiff’s car to strike the right rear axle of the trailer. Plaintiff sustained a fractured hip requiring pinning, fractured femur requiring rods and pins, ruptured patellar tendon, and damage to the weight-bearing surface of the knee (osteochondral defect). The defense denied liability and argued that Plaintiff was drag racing at the time.
