Plaintiff, a Nicor meter reader, was attacked by Defendant’s 2 German Shepherds when she entered the yard to read the meter. Plaintiff claimed that the attack last for several minutes. During that time she was curled up in a ball on the ground crying waiting for Defendant to chase the dogs away with a broom. Plaintiff sustained 3 large bruises on her hip, four small puncture wounds, and abrasions. She reported other symptoms of post-traumatic stress disorder, nightmares, anxiety, panic attacks, and depression. She stated that she began self-medicating with alcohol eventually increasing her consumption of alcohol to between a 750 ml bottle and a half-gallon bottle of Jack Daniels per day. Approximately 2.5 years later she sought treatment for her alcohol dependence. Plaintiff claimed that her alcoholism caused a strain in her relationship with her mother and husband and caused Christmas to be cancelled. The defense admitted liability for the incident but maintained that the Defendant should only be responsible for the Plaintiff’s physical injuries. Defendant’s expert toxicologist opined it was physically impossible for a person to have consumed as much alcohol as Plaintiff claimed, because if a person of her size actually drank a half-gallon of hard liquor, she would have achieved a blood alcohol content of 1.49 which is about 18 times above the legal limit to drive and about 3 times a fatal does of alcohol. The jury awarded only the medical bills and wage loss from plaintiff’s initial treatment.
Verdict: $9,380 ($1,000 past loss of normal life; $1,500 past pain and suffering, $1,238 medical expenses; $5,642 post lost income and benefits)
