Plaintiff contended that the extensive excavation work done by Affordable Demolition to his neighbor’s home caused damages to his home including cracks in the foundation wall, damage to the basement radiant floor hydronic system, cracks in interior drywall, water infiltration, mold, basement slab damage, underground storm drain cracking and undermining of the sub-grade support for the slab on grade. Plaintiff initially sought $153,670 in damages but only $127,715 was presented to the jury. The defense contended that this was nothing more than a dispute between neighbors and that the Plaintiff was over-reacting with the lawsuit. The defense further denied that their excavation work did any damage to Plaintiff’s home.
