Plaintiffs were on a motorcycle when they collided with Defendant’s vehicle as it made a right turn. The impact occurred in the parking lane and both Plaintiffs were thrown from the motorcycle. Male Plaintiff claimed neck pain and rib contusion. Female Plaintiff suffered a fractured right clavicle, loss of consciousness, right arm pain, right temple pain, right temple laceration requiring stitches and severe road rash. The defense asserted that the Plaintiff driver was negligent in attempting a dangerous passing on the right. The jury found the Plaintiff driver to be 100% at fault.
