When Damages are Personal: Property, Bodily Injury and Professional Drivers

Not all car accidents consist of massive pile-ups involving numerous cars and people being carried away to hospitals.  In fact, many car accidents involve only one or two vehicles, and involve zero ambulance trips.  Just because an accident is not “newsworthy” or does not involve gruesome injuries, however, does not mean that there was no damage.  In fact, even the smallest accident in terms of bodily injury can be life changing for those who are unfortunate enough to be involved.

Accidents and Tractor-Trailers

When a very large truck, with 18 wheels and weighing about 40 tons on average, hits a car, typically weighing in at no more than 1.5 to 2 tons, a catastrophe is inevitable.  When this happens, the car is generally destroyed.  While, of course, it is always hopeful that when a large truck and a car are involved in an accident there are no casualties involved, this situation rarely translates into one in which there are no damages.  It is a near impossibility for a truck this large to hit a car without the car being destroyed, and the lives of at least two people — the driver of the tractor trailer included — changed forever.  What many people may not realize is that there are not robots behind the wheel of the many semi-trucks on America’s highways, and they are more susceptible to accidents due to many factors that are largely out of the truck driver’s control.  Starting with a driver having worked through the night as they were unable to find somewhere to sleep, and add to that a car in an unexpected place, and you are left with the fireball that causes massive damage and catastrophic injuries.

Damages in Semi/Auto Cases

Even not taking into account the potential bodily harm involved in most of these types of accidents, the costs of losing a personal vehicle alone can be in the thousands of dollars range.  Recovering those damages in the least stressful and fastest way possible is key to an accident victim being able to return to the life they had before the accident.

When a professional truck driver is involved in an accident, there are factors at play that are not involved in a typical accident involving only passenger vehicles.  One issue that is often forgotten is that professional drivers are subject to many more state and federal regulations than other drivers.  These regulations can help a victim recover their damages much faster during settlement negotiations if they understand that proving a rule violation by a professional driver can help their argument that they would be more likely to win at trial.

What to do when involved in an Automobile Accident

Anyone who has visited the beautiful city of Chicago is familiar with the daily traffic. Most people recognize the dangers posed by millions of drivers rushing through the city on a daily basis. Few drivers know what to do once they have been in a car accident. Automobile accidents not only interrupt your day, they can disturb your daily routine for months. Having an experienced attorney handle your accident will save you endless hours of wasted time, stress and frustration. If you have been in an automobile accident, here are some things to consider.

The Opposing Party

Whether you turn a claim into your own insurance provider or the other driver’s insurance company, you will most likely need to negotiate. Misplaced trust in an insurance adjuster can cost you thousands of dollars. Insurance companies have no incentive to offer you a generous settlement and every incentive to offer you very little; they are for-profit corporations. If the other driver in the accident hires an attorney, he then has no incentive to settle quickly. When you are the injured party, you may spend more on medical bills, and you may be forced to stay home from work due to your injuries. This will make it difficult for you to wait for a settlement offer and you may be willing to settle for less than you deserve. Having an attorney handle these negotiations will ensure that you get nothing but your full compensation.

The Compensation

It is easy to be short sighted when you have been injured. When your immediate needs are to pay for mounting medical bills, it can be difficult to try and prepare for the future. While this is certainly understandable, it is not in your best interest.

When you have been injured as the result of another driver’s negligence, you are entitled to recover your full damages. This may include bills from prescriptions, surgeries, and doctors’ appointments in the present, but it can also mean physical therapy, or rehabilitative treatments in the future. It is important to keep in mind that your damaged property will need to be replaced and you may need to find alternative transportation while the repairs are ongoing; this is also compensable. Understanding the full compensation to which you are entitled will ensure that this automobile accident does not disrupt your life any more than it already has. Having an attorney assist you in preparing a demand for damages will ensure that no details are missed.

The Claim

There are a great number of details and procedural hoops to jump through when seeking recovery for an automobile accident. You will need to determine the extent of your injuries, the insurance policy that covers the other driver, and decide what amount you can reasonably settle for. You will need to discover whether the insurance company is willing to negotiate or if it is contesting your claim. You may need to determine exactly what is being contested; are you being accused of fault or is there a legal reason they are not willing to settle? All of these actions may lead you to file a lawsuit. If that is the case, there will be many new hurdles to tackle, including depositions, interrogatories, and possible counter claims. An attorney can guide you through this legal maze step by step.

External Airbags: The Future of Vehicle Safety

AirbagOnce upon a time, not too long ago, there were no such things as airbags. Heck, when I was a kid, no one even wore a seatbelt. Then again there were a lot fewer cars on the roads. Fast forward to today….airbags are the norm. They started in the steering columns and dashboards and now include those in the doors and throughout the vehicle—all positioned to lessen the impact of a collision on occupants. Again fast forward into the near future, air bags may soon be deployed from the exterior of the car.

External airbags are coming. A CNN special report on the “Future of Driving” says that airbags surrounding the exteriors of vehicles could be triggered when an accident is imminent; absorbing some of the impact before it even reaches your car.

TRW Automotive is the company leading the way in external airbag technology and they claim that the technology will be in some luxury vehicles before the end of the decade.

Side Impact TotalledA plea agreement has been offered to  Jeremy Betancourt, 18, charged with killing a friend during an illegal street race in Gurnee last June.

The defense attorney for Jeremy met behind closed doors Tuesday with Lake County Judge Victoria Rossetti and prosecutors to try to resolve the case before it goes to trial March 31.

Neither side would discuss the details of the proposal, but defense attorney Jed Stone said “progress was made” during the 10-minute meeting.

Stone has previously said there are “extraordinary circumstances” surrounding the case and, therefore, Betancourt should be sentenced to probation rather than prison.

Prosecutors have said previously that any deal would involve a judge determining a sentence for Betancourt during a hearing.

Betancourt faces charges of aggravated driving under the influence and reckless homicide for the June 24 crash that killed 16-year-old Cynthia Perez, a student at Antioch High School.

Betancourt, of the 41000 block of Circle Drive in Antioch Township, was driving erratically during the illegal street race on Route 120 in Gurnee when his Honda slid into the center median ditch, went airborne and rolled over, authorities said.

Perez was not wearing a seat belt in the back seat of the vehicle and fell out of the rear window when the vehicle flipped. She was pronounced dead at the scene.

Betancourt and two other passengers were treated and released from Advocate Condell Medical Center in Libertyville.

Betancourt was initially charged with reckless homicide and aggravated street racing, but an aggravated driving under the influence charge was added after test results showed he had marijuana in his system.

He was released on $100,000 bail so he could enroll in a substance and behavioral assistance program. Betancourt has been released from a Lake Villa treatment center, but remains at home on 24-hour curfew.

Can a Minor Be Sued In Illinois?

Robert Edens ‘Bob’ is an award-winning Lake County motor vehicle accident attorney with over 20 years of experience fighting for victims of negligent drivers. His Antioch personal injury law firm will provide you with the legal advice you NEED to answer your questions and explain your options.

Attorney Robert Edens Auto, Motorcycle and Other Vehicle Accident Representation. The Call is Free, The Advice Might Be Priceless

lawsuitThe question of whether or not a minor can be sued does not have a straightforward answer. It is not as simple as the question “can you enforce a contract with a minor?” Which is a simple no.

Laws vary from state to state. According to the Illinois State Bar Association, the first distinction is the age of majority vs. the age of a minor. It varies for individual situations. For example, a person 18 years of age is able to vote, join the military, and enter into contracts but not purchase or consume alcohol. Additionally, a 16-year-old who has obtained a driver’s license can be held responsible for injuries or property damages if they are found to be at fault for a car accident.

However, in any case, in which a minor cannot be sued, their parent(s) or the person that is legally responsible for them can be, and often is. If you, or your minor child, have had a civil lawsuit filed against them, I highly suggest consulting an attorney. This is a gray area of the law and you need an experienced attorney to protect the rights of both the minor child and their guardian(s). Please call me for a free case evaluation today.
